Kate wants to hear from you! The next question of the week, straight from Kate, is: The young killer of Lawrence “Larry” King, an openly gay student in junior high school in Oxnard, CA, could get 42 years in jail. If you were the sentencing judge, what would you recommend?

As a defense attorney that defends juveniles accused of a myriad of crimes and a lesbian, I am torn between two worlds in this case. The act was heinous, however the killer was also a child. If I were the sentencing judge I would split the sentence if the law permits. I believe both justice and rehabilitation would be best served by keeping the child in a juvenile facility until 21 then up to 20 years in adult prison where he would be required to go on to higher education.
Lets not forget that both of these young people were children, not even old enough to drive. One life is gone and the other is forever altered by an impulsive act.

we need to make an example out of the kid who killed him. give him the whole 42 years. we as a community need to learn to show no mercy in order to eventually gain some respect from somewhere.

While I do believe that the act was disgusting, as I do in all cases of this nature, I honestly don’t feel that the child involved in this case fully understood what he was doing.
I am not defending his actions, nor am I saying that what he did should be completely and immediately forgiven; justice must be served. However I agree with Jzaengle in this instance but I would add that he should be required to undergo some sort of extensive therapy. Lord knows that in addition to the hatred he seems to feel towards homosexuals, what will happen to him when and if he suddenly sees the reality of the situation, if he hasn’t already, that he is responsible for the death of another.
If he does not receive some sort of therapy or on going analysis, how messed up will he be in 42 years when he is released to mingle with the general public who will be, according to the past 40 years, even MORE tolerant of homosexuality?
